Dear Ranger Voorhis:

Please accept these comments on the Badger Flats Management Project on behalf of The Trails Preservation Alliance (“TPA”) The Colorado Off-Highway Vehicle Coalition (“COHVCO”).   The TPA is a volunteer organization created to be a viable partner to public lands managers, working with the United States Forest Service (USFS) and the Bureau of Land Management (BLM) to preserve the sport of trail riding.  The TPA acts as an advocate for the sport and takes the necessary action to insure that the USFS and BLM allocate a fair and equitable percentage of public lands access to diverse trail riding opportunities. COHVCO is a grassroots advocacy organization representing approximately 150,000 registered off-highway vehicle (“OHV”) users in Colorado seeking to represent, assist, educate, and empower all OHV recreationists in the protection and promotion of off-highway motorized recreation throughout Colorado. COHVCO is an environmental organization that advocates and promotes the responsible use and conservation of our public lands and natural resources to preserve their aesthetic and recreational qualities for future generations.  TPA and COHVCO are referred to collectively in this correspondence as “The Organizations.”  The Organizations offer the following comments and concerns regarding this project.

  1. We acknowledge that the South Park Ranger District has struggled with the proliferation of non-system trails in the Badger Flats area and the increased demands for camping.  However, we feel much of this stems from an increasing need and demand for motorized recreational opportunities on public lands in general and especially near urbanized areas along the Front Range of Colorado.  Badger Flats is unique in that it is within 60 miles of Colorado Springs, the second largest city in Colorado with a population well over 400,000.  As the State of Colorado’s population has grown, so have the sales of Off Highway Vehicles (OHV’s), camping units and other forms of outdoor recreation increasing the demand for recreation sites like Badger Flats.  Because of the flat and rolling terrain of the Badger Flats, this area offers very unique opportunities for beginner riders, families with children and groups wishing to ride together.  The opportunities available in Badger Flats are truly unique and are unmatched by any other location within the Pike San Isabel National Forest. We would offer that much of the increase in illegal user-created routes, braided routes & trails and large unauthorized group campsites are a result and reflection to inadequately meet the needs and demands of the public and the recreational users who choose this area.  An adequate and varied inventory of routes and trails that fulfills the user’s spectrum of needs for variety, difficulty, destinations, challenge, terrain and scenic opportunity will lead to improved compliance and less off route travel.  Closure and reduction of recreational opportunities and the resulting concentration of the ever increasing number of users, has shown again and again that the desired results are not obtained.
  2. We applaud the South Park Ranger District’s goal (as conveyed in the public Open House, on December 17, 2015 in Woodland Park) to maintain a “system” network of roads and trails with a similar total aggregate mileage.  That the length of closures will be approximately equal to the length of new roads and trails added to the system.  However, we are concerned that there will be a significant loss of road and trail opportunities when a large number of the “non-system” roads and trails are closed or decommissioned.  Once again the proliferation of these non-system roads and trails is likely linked to an ever increasing demand for multi-use recreational opportunities.  We would encourage the South Park Ranger District to consider inclusion and adoption of more “non-system” roads and trails to help meet the area’s recreational needs and demands.  This adoption of previous non-system trails would not be unprecedented as demonstrated by the recent proposal by the Pikes Peak Ranger District to adopt the Buckhorn Trail in the Bear Creek Watershed area from a “user created” trail to a “system” trail.  We would also question if any of the “non-system” routes designated to be closed or decommissioned were indeed historic routes that existed prior to 1984, and may have been omitted from the Motorized Vehicle Use Map (MVUM) development process.
  3. The economic impacts of recreation within the Badger Flats area cannot be overlooked and is certainly important to Park County and the surrounding Counties.  Significant economic benefits are realized by all of the nearby communities such as Lake George, Woodland Park and Divide among others as the public travels to and from the Badger Flats area.  Badger Flats provides unique opportunities for motorized recreation because of its terrain and close proximity to the Front Range.  Both residents and non-residents travel to this area to participate in the unique OHV opportunities afforded by the Badger Flats area.  As an example, motorized recreational enthusiasts were responsible for $990 million in direct expenditures relating to motorized recreation in Colorado during the 2012-2103 season.1   As popular as the Badger Flats area is, the economic benefits of this area to the surrounding local economies of nearby communities cannot be undervalued.
  4. Below are specific comments relating to the proposed action:
    1. Road and Trail Comments:
      1. The closure of Forest Service Road (FSR) 704 (vic US 24 and PRK-90) appears to leave only an isolated section of FSR 704 open to use?  How will this trail segment be accessed?  Will public access to St. Joe Tunnel still remain?
      2. Suggest considering a connection and road/trail loop development between the FSR’s on the south side of US 24 (e.g. FSR 860) across US 24 to FSR 704/704.C.  Re-evaluate closure of FSR 860.A as there are several select camping sites along that road.  Rather consider a connection from the intersection of FSRs 860 and 860C northward to tie into FSR 860.A.
      3. We would encourage more opportunities like the proposed FSR 247 & 259 loop.
      4. Please clarify intentions for changes to the FSR 213 corridor between PRK-31 and PRK-77.  The depictions on the map do not adequately convey the intentions of the combined closure and adjacent proposed new FSR.
      5. Reconsider keeping the FSR 214.B loop open.  This adds opportunities and loop opportunities for OHV recreation in and around the proposed designated dispersed camping areas along FSR 214.C and 206.A1
      6. We understand the need to close FSR 44 (along with FSR 44.2C, 44.2B and FSR 280) on the west side of La Salle Pass is due to an existing eagle’s nesting area.  Closure of this road eliminates the small loop and option for alternate routes to La Salle Pass.  We would offer that this closure should be temporary, and in the future if the eagles are no longer in the area, that this road be reopened.
      7. Consider creating & enhancing a larger loop opportunity as follows:
        1. Begin near the intersection of FSR 313 and PRK-31, travel east on FSR 313 to PRK-77
        2. North along PRK-77 (as proposed)
        3. Along FSR 212.A to FSR 212
        4. Consider a new connection from the intersection of FSR 212 and PRK-77 west to the intersection of PRK-31 and FSR 231/230
        5. This enhances the opportunities with the proposed FST 230 and FSR 237 changes
      8. Consider a parallel OHV route along PRK-31 to connect the proposed designated dispersed camping areas near Round Mountain with FSR 213 and the associated routes north of FSR 44
      9. The steep section of FSR 295, just north of the gate near the intersection of FSR 295 & 296 could use some maintenance and or consideration for re-routing to increase sustainability of the road
    2. Camping Comments:
      1. How will enforcement and signing of newly designated dispersed camping areas be accomplished.  The localized and specific limits of the proposed designated dispersed camping areas appears to be more difficult to enforce and maintain then designating simple corridors (e.g. 300-ft each side of a road)
      2. What are the proposed limits (i.e. how many feet) for the proposed designated dispersed camping areas from the edge of the roads?
      3. Since the choices of locations to camp are being curtailed, how will the proposed designated dispersed camping areas be maintained for safety, such as hazard trees, location of camp fires, shooting, etc. to name a just a few?
      4. How has the capacity of camping sites/opportunities been impacted by the proposed changes?  What are the approximate numbers of camping opportunities/sites lost or eliminated versus new ones created?  There appears to be a significant loss of camping opportunities?
  5. Conclusion

The Organizations generally support the proposed action for the Badger Flats Management Project.  We acknowledge the need by the USFS to improve the management of recreation in this very popular and unique area.  However, we would offer that better compliance and improved management stems from adequately meeting the recreational needs and demands of the users.  We fully understand and support your mission to protect and preserve our precious forest resources, to manage all of the competing uses of the forest, but that mission must be fulfilled while simultaneously providing the resources and recreational opportunities for the public to enjoy in a manner that fulfills the needs and demands of the public.  Solely reducing or curtailing OHV recreational opportunities in Badger Flats will likely not achieve the management objectives for the area, but a comprehensive approach to provide an adequate and varied inventory of routes and trails, that fulfills the OHV user’s needs for variety, difficulty, destinations, challenge, terrain and scenic opportunity will improve compliance and less off route travel.

Dear Mr. Bodhane:
Please accept this correspondence as the follow up correspondence relating to the Western Governors Association meeting in Cody, WY targeting Species Conservation and Endangered Species Act issues (“WGA initiative”) submitted on behalf of COHVCO, CSA, TPA. Prior to addressing our experiences with the Endangered Species Act, we believe a brief summary of each Organization is needed. The Colorado Off-Highway Vehicle Coalition (“COHVCO”) is a grassroots advocacy organization the 150,000 registered OHV users in Colorado seeking to represent, assist, educate, and empower all OHV recreationists in the protection and promotion of off-highway motorized recreation throughout Colorado. COHVCO is an environmental organization that advocates and promotes the responsible use and conservation of our public lands and natural resources to preserve their aesthetic and recreational qualities for future generations.

The Trail Preservation Alliance (“TPA”) is a 100 percent volunteer organization whose intention is to be a viable partner, working with the United States Forest Service (USFS) and the Bureau of Land Management (BLM) to preserve the sport of trail riding. The TPA acts as an advocate of the sport and takes the necessary action to insure that the USFS and BLM allocate to trail riding a fair and equitable percentage of access to public lands.

Colorado Snowmobile Association (“CSA”) was founded in 1970 to unite winter motorized recreationists across the state to enjoy their passion. CSA advocates for the 30,000 registered snowmobiles in the State of Colorado. CSA has become the voice of organized snowmobiling seeking to advance, promote and preserve the sport of snowmobiling by working with Federal and state land management agencies and local, state and federal legislators.

While the primary mission of the Organizations most directly relates to motorized recreation, the overall scope of the Organizations often has a larger impact as motorized recreation and access can take many forms and involve many activities, including camping, hunting and fishing and other recreational activities where motorized access to public lands is critical but not the primary recreational activity sought. Under federal land management standards, when an area is open to motorized access it is rarely closed to any other activity. For purposes of this document, CSA, COHVCO and TPA are identified as “the Organizations”.

The Organizations welcome this discussion as we believe a review of the Endangered Species Act (“the Act”) is badly needed and look forward to involvement in the process moving forward. The Organizations believe that the ESA must become both more efficient and more consistent in its impacts between species and over time and effectively achieve species populations that allow for the delisting of species. When the ESA was originally passed, there was strong bi-partisan support for the Act. This support has eroded due to some foundational problems with the Act which have manifested themselves in various listing processes. Significant erosion of support has resulted from technological advances that have been made since the passage of the Act, as exemplified by recent advances in DNA testing and analysis, which has resulted in impacts to the listing process that simply were never envisioned when the Act was passed. The Organizations submit there is a need to simply update the Act and refocus on effectively achieving many of the original objectives that were to be addressed. The Organizations are submitting these comments in order to fully explain some of our concerns after a more complete review of these issues.

The Organizations are involved in large number of species related processes from landscape level planning, such as recent Greater Sage Grouse efforts, to local efforts often on areas smaller than a Ranger District. This involvement has ranged from: On the ground support for on-going wolverine research; Active participation in various stakeholder efforts; Funding extensive habitat restoration efforts through the State OHV grant process; intervening in ESA related litigation and actively assisting in the disbursement of the new Lynx Conservation Assessment and Strategy to land managers. The Organizations submit that ESA related issues are the single largest threat facing all recreational activity on public lands. This relationship cannot be reconciled with the fact that recreational usage of public lands is often totally unrelated to species decline, as too often land management decisions are based on the need to appear to do something for the species rather than sound scientific process to benefit the species.

The Organizations would submit that recreational interests and groups must play a more prominent role in WGA initiative moving forward, as there are a wide range of recreational activities occurring on public lands. These activities represent a massive economic driver for all levels of regional economies and are critical component of the western lifestyle. While many attendees at the meeting in Cody were thrilled with the non-listing of the Greater Sage Grouse, the Organizations are not ready to declare those efforts a success from a recreational perspective. The Greater Sage Grouse process has not been the normal experience in the handling of ESA issues, and this must not be overlooked. Determinations regarding many species with smaller habitat areas are often made without significant review and based on significant uncertainty in science and management, simply due to the volume of proposals and efforts that are on-going. The cumulative impact of these smaller species efforts is that there are few locations on public lands that are not identified as habitat for some type of plant, animal, fish or insect. The cumulative management situation presented identifies many issues in the process that must be resolved in order to develop a more effective ESA moving forward.

1. At the landscape level, the listing/delisting process for any species is simply badly out of balance. While it is comparatively easy to list a species under the Act, removal of any species from the list is functionally impossible. Clearly this imbalance of processes was not envisioned when the Act was passed, as public support for a process that resulted in easy additions to the list and the impossibility of removal of any species would not have garnered large scale support. The Organizations welcomed discussions surrounding the heightened listing requirements that were recently initiated by the USFWS, such as increased state involvement and scientific review prior to acceptance of a listing petition. While this is a step in the right direction, this simply does not resolve the imbalance in the two processes problems.

The Organizations submit that some type of filing fee associated with the petition process should be looked at on a per species/per petition basis. In association with this filing fee, a requirement of each petition only addressing a single species should be addressed. The implementation of a filing fee and single species per petition requirement would have minimal impact on the delisting process as often any delisting is done on a species specific basis. The Organizations submit that these criteria would be important steps in addressing the recent flurry of listing petitions targeting hundreds of species in a single document. These petitions are often difficult to understand and try and associate particular issues with particular species. Clearly these types of petitions were not envisioned when the Act was passed and are insulting to both the parties to the efforts and the goals and objectives of the Act. The Organizations submit that any benefit to any species that could result from these super petitions is minimal at best.

These new petition requirements would address one of the major impacts on the ground from the imbalance of the entire process, mainly that the filing of any petition regardless of how poorly scientificly based has a huge chilling effect on efforts that might involve habitat areas or efforts to mitigate threats. It has been the Organizations experience that the mere assertion of a possible listing of a species has a huge unsettling effect on any efforts to improve habitat or mitigate threats as often land managers stop anything in the habitat area when there has been a petition filed, as land managers are simply unsure how to proceed.

2. The current version of the ESA simply does not work. Many assert that the overall success rate of the ESA is only 1% based on delisting of species and others assert that the Act is 99% effective as only a few species have been found extinct. While the Organizations believe that the 1% delisting levels may not be the best measure of the effectiveness of the ESA, the Organizations support the position that the ESA has been minimally effective in increasing species populations in most cases. The exact percentage of species listed or delisted really does not impact that position.

3. Too often the ESA is relied on by those who are opposed to projects and failed to be involved in the NEPA process. The ESA process allows an entirely separate course of action often allows those opposed to a project to derail collaborative efforts that might be in place to benefit the species that have been developed in the NEPA process. The Organizations are aware of numerous trail improvement projects that are derailed by ESA issues raised by those that are merely opposed to multiple use. It has been the Organizations experience that the driving force of some of these efforts has more to do with a personal interest opposing a project or philosophical opposition to a particular activity. This must be addressed.

4. Hard population goals must be set for a species or DPS and must be honored in the delisting process. Too often population goals are not provided in the ESA process at all and if there are population goals provided, they simply are not honored. These types of hard objectives are the general standard for the management of a challenges being faced by the country, and as such should be applied to ESA actions. This is simply good management and is a critical in developing public support and coalitions that are necessary to improve species populations. The goal simply gives the public something to rally around and work towards.

On January 18, 2011, President Barack Obama issued Executive Order 13563, which specifically required that all agencies:

“(4) to the extent feasible, specify performance objectives, rather than specifying the behavior or manner of compliance that regulated entities must adopt;”1

The requirement of EO 13563 that all agencies provide performance objectives is highly relevant to the management under ESA. Logic dictates that any determination that a population is sufficiently threatened to warrant listing would rationally require that a target population for the area has been created and it has not been met. Rather than specify what this target population in the documents released, often these target are omitted, violating the clear mandate of the Executive Order and hampering effective management of the species moving forward. Providing identifiable population goals for areas would be a critical component of public comment for wildlife management professionals and researchers, as often the target population and methods of identifying accurate measurement methodology are the basis for extensive analysis and comment from these groups of the public. Without target goals, this comment simply is not obtained.

The Organizations believe that these identifiable goals will be a critical component of public support for the management of various species in the future. This public support for management will allow private lands to be managed with a variety of tools for improving grouse habitat.

5. The §7 consultation process must be amended to insure that both positive and negative benefits from planning efforts are reflected. Too often the Organizations are aware that land managers stop analysis of ESA issues at determinations of “no negative impact” from planning in the §7 consultation process. The Organizations submit that stopping at this point precludes viable opportunities to benefit species as managers often continue without asking if the proposal is even related to the threats to the species. The impacts of such an arbitrary limitation on analysis recently occurred in the Bear Creek area outside Colorado Springs. Managers were sued regarding recreational usage around Bear Creek and possible impacts on genetically pure cutthroat trout. Litigation was settled and NEPA was commenced but no one ever identified the threats to the species at the location or that a very old and deteriorated dam was the only obstruction between the genetically pure fish and their primary threat, mainly reintroduced hybrid fish. This arbitrary limitation on analysis should be avoided as limited resources can easily be directed towards issues that are entirely unrelated to the species decline.

The US Supreme Court recently specifically addressed the situation where resources were directed towards minimally significant issues and stated as follows:

“And it is particularly so in an age of limited resources available to deal with grave environmental problems, where too much wasteful expenditure devoted to one problem may well mean considerably fewer resources available to deal effectively with other (perhaps more serious) problems.”2

Given this clear statement of concern over the wasteful expenditure of resources for a certain activities in an attempt to manage an environmental issue, the Organizations are very concerned regarding what could easily be the wasteful expenditure of resources for the protection of several species in the Proposal, as recreational usage of habitat areas simply is not an issue contributing to the decline of the species.

6. The question of “What is a species?” simply must be resolved. Currently if a possible species fails any portion of the questions used to define “what is a species” is the species is listed. This situation is the basis for ongoing and vigorous discussion in the scientific community. As a result two species can look identical with slightly different genetic traits, but be broken into separate populations and both be listed. On the conversion, species can look very different and be genetically identical and again both be listed. This situation has been exemplified with the Alabama sturgeon, Greater/Gunnison Sage Grouse and is exceptionally common in the listing of various plants, where exceptionally minimal differences are identified as the basis for an ESA listing and a common weed. The Organizations are intimately aware that answering this question has profound impacts on many facets of ESA actions but it must be looked at. The ever changing target of what is a species makes conservation efforts difficult if not impossible.

7. Funding of litigation efforts is simply badly out of balance with resources directly benefitting the species. The Organizations submit that the funding of litigation efforts and defense of litigation brought against the USFWS is simply badly out of balance with the portion of resources directly benefitting the species. The Organizations propose that a revision of the Equal Access to Justice Act must be looked at as part of this discussion as ESA and EAJA have created a cottage industry where certain groups to sue to government on ESA issues and then recover all legal fees when any portion of the action is successful. The Organizations believe that these petitions often have little or nothing to do with increasing populations and are often found sufficient due to funding limitations and the large number of species that are either listed or proposed to be listed.

The imbalance of EAJA provisions are compounded by the fact that parties that intervene to assist in defense of claims with the government are functionally precluded from recovering their legal fees. The Organizations submit there are three alternatives; 1: increase the burden on parties to recover funding for ESA litigation on EAJA; 2: remove ESA actions from EAJA; 3: allow interveners to recover costs.

8. Funding for active management of threats must be expanded and used in partnership with other governmental agencies. While the ESA has provisions to allow federal monies to be directed to states under §6 §6 money is simply not available at levels to really make any difference to a species. Not only are state level efforts the primary location of specific species knowledge and expertise State level efforts are the primary source of funding for the management of both proposed species and any species that might be listed. Often state funding to manage species is provided at a factor of 10 to 20x levels of federal money that is available under §6. The Organizations submit that reallocation of Land and Water Conservation Fund money could represent a viable source for significant additional federal funding to benefit species on the ground.

9. Better science must be developed on species. Too often the lack of science is seen as a basis for listing and often listing of species is based on a lack of science, such as happened with the Canadian Lynx. While much of the lack of science around the Canadian Lynx has been resolved, this resolution has taken almost 2 decades to develop due to exceptionally limited funding. This is simply unacceptable.

While the Organizations welcomed the attempts in the Greater Sage Grouse planning efforts to tailor Sage Grouse plans to address more site specific issues and challenges facing various populations, the Organizations are very concerned that any information and research exchange behind the scenes was limited at best. Many exceptionally similar species were listed (Gunnison Sage Grouse in Colorado) under situations and circumstances that were exceptionally similar to the circumstances that led to the non-listing of the Greater Sage Grouse. This type of consistency is critical to the development of an ESA on the ground.

10. Cumulative economic impacts of multiple listings must be looked at. While the Greater Sage Grouse efforts have garnered a significant amount of public interest due to the large habitat areas at issue, many species that are listed have smaller habitat areas. These smaller habitat areas does not mitigate the impacts of the large number of small habitat areas has on public lands and recreation. Often it is difficult if not impossible to identify any public land that has not been identified as habitat for an Endangered Species in the state of Colorado. These cumulative impacts are simply never reviewed.

The Organizations must express frustration with economic analysis provided in some listing proposals which rely on agency costs as the economic impact of habitat designations. Agency costs simply are not the proper measure of economic impacts to local communities, and this should be clearly and unequivocally stated in regulations moving forward.

11. Warranted but precluded status generally. In the recent landscape settlement regarding the administratively created status of warranted but precluded the USFWS withdrew the status as a valid listing position. The Organizations submit the “warranted but precluded” status should be reinstituted legislatively. Any revision to the ESA should clearly identify this status moving forward as the status provided significant flexibility in the prioritization of species under limited budgets. The removal of this status by the service was a mistake as there will always be management discretion in the management of this many issues, regardless of the issues being managed. The Organizations do not believe sufficient funding could be supplied to allow for complete management of all species that have been listed or are under review for listing.

12. Landscape level/multispecies conservation efforts. There has been extensive discussions regarding the need for landscape level efforts to address multiple species in order to reconcile management and impacts to species. The Organizations believe this is an interesting discussion but only a small piece of the puzzle. One of the foundational principals of this type of analysis is the assumption that the decline of species is related to a lack of habitat. Often this is not the case.

Such management and analysis is also exceptionally complex and highly localized as exemplified by the Desert Renewable Energy and Conservation Plan in California, where efforts similar to this were undertaken. While this process remains on-going the efforts have proven exceptionally complex, often difficulty has arisen in coordination of efforts and research and in the Organizations opinion has produced a product that has strayed badly from the original purpose and need of the Proposal. The Organizations believe these efforts are interesting but present significant issues when looked at from a cost/benefit position, unless the proper scale of analysis is looked at. Rather than require additional analysis in the ESA process, the Organizations believe that accurate and meaningful analysis of current efforts and at current geographic levels must be required. Similar goals can be achieved with significantly lower costs.

13. Impacts from previous ESA efforts should be recognized. The Organizations are aware of several situations where there have been negative implications to ongoing efforts that have established viable and sustainable species populations for species that have been listed that such as the reintroduction of the Canadian Lynx in Colorado and Grizzly bear around Yellowstone. These stumbles have had major impacts on the future management and reintroduction of any species. Colorado legislature immediately acted after lynx listing by requiring specific legislation to reintroduce any species that might be listed. As part of any recommendation, certain species/populations should be looked at for delisting in the legislation such as the grizzly bear, lynx in Colorado and Gunnison Sage Grouse.

Off-Road Business Association (ORBA)

Off-Road Business Association (ORBA) is a new organization that the TPA is working with. This is their Mission and Purpose letter.

Mission and Purpose

The Off-Road Business Association (ORBA) is an international trade association. The membership ranges from large international corporations to “Mom & Pop” small businesses. Another important component of membership is the state, regional and national “Grassroots” organizations and associations.

The ORBA mission is to promote responsible and meaningful recreation opportunity on public and private land. Provide the working collaborative platform for business to communicate and develop a positive atmosphere and provide information necessary for success.

ORBA staff is highly educated, trained and experienced in their field. The staff has over seventy-five years of experience in managing recreation throughout North America and have written legislative language at state and federal levels. They have testified before congress and in several state legislatures, managed and administered state and federal programs. Staff develops scientific and statistical data necessary for policy implementation. They have served as appointees on several key collaborative efforts addressing federal land use i.e. Desert Renewable Energy Conservation Plan (DRECP), U.S. Forest Service; Lake Tahoe Basin Management Unite (LTBMU) “Winter Travel Management” (sub-part C) collaborative process, Bureau of Land Management; Special Recreation Permit (SRP) sub-group process.

National partnerships include; Tread Lightly, Americans for Responsible Recreation (ARRA), Specialty Equipment Marketing Association (SEMA), United Four Wheel Drive Association (UFWDA), and Motorcycle Industry Council (MIC).

The Board of Directors is made up of a cross-section of industry leaders that bring a unique business perspective to the direction and management of ORBA. The perpetuation of responsible recreation is extremely important to the successful longevity of business.

Oftentimes when we, or anyone for that matter, start talking about land management and dealing with the serious issues of our sport’s future, people begin to get squeamish, with feelings of guilt and denial. The purpose of this story is not to guilt-trip you or ask for your money, but hopefully it will paint a better picture of why you should participate in the Colorado 600 and what the future of off-road riding on public land holds.

For those unfamiliar with the Colorado 600, the first thing you should know is that it is a fan-freakin’-tastic event. At its core, the 600 is a four-day trail ride through the ridiculously cool single- and two-track of the Rocky Mountains with a select group of about 75 riders. When we say “select group,” it is because participants must apply to ride the event. The TPA (Trails Preservation Alliance) has set up the event to always include about a third returning invitees, a third core industry people, and a third new participants. This guarantees a good mix of people of many different experience levels, in both riding and dealing with land management.

Each day, multiple group rides start and end at the same location and range from dual-sporty, easy rides to expert level, borderline EnduroCross rides, all depending on the guide you choose to ride with and where they are going that day. There are about 10 dedicated guides who know the area extremely well, and the casual nature of the 600 encourages riders to seek other people to ride with and make some great friends in the process.

Brad Schluter, first-time participant, shared his experience with this sort of organization: “I think it is slightly less of like, ‘Here’s a beginner ride. Here’s a tough ride.’ Since all these guys are friendly it’s more, ‘Hey, join up in our group, and here’s what we are doing.’ Also, it has been great to meet new guys to ride with. I’ve already met four or five guys who live within an hour of where I do and who ride a lot. I imagine I’ll end up riding with them. Meet some new people, ride new trails, hang with guys who ride, and have a good time.”

Each morning, all riders gather for breakfast, and Don Riggle, director of  operations for the TPA, leads a discussion of current land-management issues, past defeats and victories, and upcoming matters that should be on our radar. There are also guest speakers who share what has and hasn’t worked in their particular riding areas.

At this year’s event there was a distinct theme to much of what was discussed: perspective. If you don’t know that you lost anything, how can you miss it, right? Unfortunately, the fact that so many trails have been closed over the years is something that is lost on the younger generations of trail riders. They have a modern perspective of the trails that we have and think that if we are just keeping the existing single-track, we are in good shape, but that isn’t the reality.

“Sadly what we have done is, we’ve gone on the defensive,” John Sawazhki, longtime CO600 participant, says, “And at the end of the year we say, ‘Well, we’ve only lost 20 percent.’ Somewhere along the line we need to go on the offensive and get some of it back. In Colorado, the TPA has done that, so there is some hope.”

At one breakfast discussion, we talked about the 2005 Travel Management Rule put in place by the Department Of Agriculture. Before this, the general rule of thumb was if an area, trail, or road isn’t specifically marked closed, it is assumed to be open for off-road use. But the Travel Management Rule basically reverses that idea. Now, if it isn’t specifically marked for off-road use, it is to be assumed closed. This is a major difference between the generations of trail riders. Many of the older guys talked about how they used to just ride from their garage and pretty much go where they wanted. This is a foreign concept to many younger riders because they’ve always had to load up the truck and go somewhere specifically marked to ride.

“Look around the room,” Don said at breakfast one morning. “We are the old guys in this fight, and we need younger guys involved. I don’t have all the answers; I don’t have all the new ideas. That needs to come from the new guys.” The simple fact of the matter is that Don and his cohorts in the TPA and other organizations fighting for off-roader’s rights are pretty much the first generation that has done this. They are all getting into their 60s and 70s, and although they can ride like the best of them, they aren’t going to be around forever. Simply, they need new members. “We are in a unique position as the old guys who have some income, some money,” Sawazhki continues. “We probably have more money than we have life left, so we can help with the money. But young guys, the new guys, they can help with the backbreaking work and fighting the establishment, if you will.”

Along those same lines, Scott Bright, ISDE and Enduro racer, wants younger riders to get involved. “Perspective is something that is lost on people who never saw what it used to be,” Scott says. “If you have a local riding area that you love to go to right now, and everybody has one, and somebody came in and had way more money than you did and they decided that they wanted to shut that down and wanted to use it for a nature preserve, how would that make you feel? Where would you go ride then? How big of a defense would you put up? That’s what the TPA is all about: making people aware of what’s going on. It’s really helpful for the younger generations to learn about all of the trails that were available 20, 30 years ago and the massive amount of trails that we have lost since then. If it weren’t for the organizations like the TPA there wouldn’t be anything left. “Something else, the Colorado 600 is about single-track,” Scott continues. “We are not out here fighting battles for ATVs or UTVs, or four-wheel drives, or snowmobiles, or anything like that. It’s all about preserving single-track for guys on motorcycles. If anyone cares about riding single-track on motorcycles on public lands, then they need to be aware of what the TPA is doing.”

With all this emphasis on getting new blood into these organizations, we don’t want to downplay the value of experience, both on and off the bike. Now is an absolutely great time to ride the Colorado 600 because there is so much to learn from the returning riders. Tim Haight, first-time participant, explains: “I was actually surprised at some of these riders’ abilities. Just looking at some of these guys, you wouldn’t expect it, but you find out that they are phenomenal riders. It’s really shocking. At the end of the day, I had a lot of new found respect for a lot of guys. They were really great.”

Brad Schluter had a similar sentiment. “It’s cool to ride with these more experienced riders,” he says. “You get the feeling that a lot of these guys have a lot of history in motorcycling, and they are willing to teach what they know. You learn a lot. Bike stuff to riding skills, you always learn a lot from riding with guys with more experience than you, how they tackle stuff on the trail. It was awesome.”

THE NEXT STEP
Here at Dirt Rider, we don’t have an easy answer because there is no one answer. But one thing we can say is that the guys and gals on the front lines fighting for the right to ride are going to be hanging up their hats soon, and we, the current riders and trail users, need to figure out the solution. After all, the future belongs to the young, as they say, so it is the young who have to protect it.

We understand that teenagers and even twentysomethings don’t have thousands of dollars lying around to donate. But, hopefully, they want to ride as often as possible. Joining a club is one way to not only help the sport but also to ride—a lot. Clubs put on races, clear trail, work with local land managers, and go on a lot of rides together. This is a great option for those who are “short on money but long on time.”

Another way to help the sport without changing much is to make sure all of your bikes are properly registered and make sure to pay the day or camping fees at OHV parks. Most of the money from permits and vehicle registration goes back to trail systems. Also, shop where you ride. Get your ice, water, food, and other ride day necessities at establishments around where you ride. That supports the local community and makes business owners see that off-road riders are a positive customer base.

Lastly, go on rides like the Colorado 600. Yes, it costs money and takes time, but the riding is absolutely incredible. And probably more importantly, the experience, the friends, the connections, and the knowledge gained are all way more valuable than the money you spend to get there. The bottom line is that the future is in our hands whether we like it or not, and we all have to decide what we are willing to do to make it a better and brighter place for the off-road community.

Dear Ms. Connelly:
The Trail Preservation Alliance (“TPA”) would like to reaffirm our commitment to maintaining sustainable multiple use recreational opportunities on the Pike/San Isabel (“PSI”) National Forest following the settlement of recent litigation challenging 500 miles of routes currently on the MVUM. The TPA has partnered with the Forest Service at significant cost in the defense of this and many other legal challenges to multiple use recreation on USFS lands. These legal proceedings have resulted in significant wins for multiple use recreation, as exemplified by the dismissal of general challenges to MVUMs on the Rico/Delores RD of the San Juan National Forest. TPA submits that the precedent from this precedent, mainly that scientifically defensible trails are legally defensible, must be a cornerstone of planning under the tight court mandated requirements of the PSI settlement.

TPA is aware that funding of many aspects of trail development and maintenance projects have been knotted on the PSI since this litigation was filed. Many districts have not undertaken short term maintenance for duration of lawsuit and other have stopped implementation of projects that have been approved by site specific analysis, such as the South Rampart Travel Plan, routes in and around the Hayman Burn/ Wildcat Canyon and Badger Flats areas. These are routes and projects that benefit all users. TPA vigorously asserts implementation of these decisions must move forward and ready to support any efforts to obtain necessary funding through the CPW OHV grant program.

TPA further supports any efforts to leverage the good management crews, funded by the CPW OHV grant program, that are in place on many districts of the PSI. TPA can verify that these crews are highly effective in addressing local resource issues and will be a major tool for land managers moving forward. These crews should be able to address any short term resource issues that might be present from the litigation and avoid the loss of long term opportunities due to short term resource or maintenance issues. A complete review of the projects for these crews next summer should be undertaken. TPA is very willing to assist in these efforts. TPA is further aware that multiple use trail based recreation is a significant positive year round economic benefit to many local economies in the PSI area such as Lake George, Deckers, Florissant, Hartsel and Woodland Park. TPA submits that maintaining current high quality recreational opportunities is a critical component to the basic stability of these communities and their ability to provide basic services necessary for these communities to move forward.

TPA would also like to address their experiences involving trail proposals outside the PSI, while the lawsuit has moved forward. There has become a belief that creating single use trails to benefit small user groups is the path forward. TPA submits single use trail development should be avoided and would note that many issues have come forward in development of these types of trails. Funding is often problematic as the only user group who has funding for trail development and long term sustainability is the motorized community, who is often sought to be excluded from these proposals. TPA vigorously supports the position that different types of trails provide different experiences to different users but also assert that each type of trail should be managed to remain open to the largest number of users and allow for the most funding long term. Bear Creek efforts have proven to be difficult to enforce as motorized organizations are one of the only ones supporting USFS interim closures. TPA vigorously supports USFS efforts to maintain motorized recreational access and avoid possible Greenback Cutthroat Trout habitat issues in the area. Building partnerships is critically important to move forward on the PSI and this cannot be done by excluding groups for the benefit of other groups.

TPA is also working toward combining many of the new trail management resources and updates to various scientific documents involving recreation, such as the new Lynx conservation assessment and strategy in the near future for your reference. TPA is aware that often awareness of some of these documents is exceptionally limited and hopes these resources allow for best available science to be relied on as PSI moved forward under the aggressive litigation deadlines.
